Can Police Officers Smoke Weed? Department Rules in Legal States

Three young police academy recruits on a locker room bench, one holding a sealed urine drug test cup

Adults can buy weed legally in 24 states, and some of those adults wear a badge. Their neighbors can light up after a shift. Most officers cannot.

The reasons sit at three levels: federal gun law, state cannabis law and the rules of each department. They do not always agree, and in New Jersey the clash has been in court since 2022.

Key takeaways

  • Federal law bars unlawful drug users from having guns, and recreational marijuana is still federally illegal.
  • In June 2026, the Supreme Court ruled that a regular marijuana user could not be prosecuted under that gun law, though the ruling was narrow.
  • New Jersey lets officers use legally bought cannabis off duty, and courts have ordered fired officers reinstated.
  • Washington and Minnesota leave police out of their cannabis hiring protections, and Chicago fired an officer over a positive test in 2025.
  • Hiring rules are shortening the time an applicant must be marijuana-free, from two years to six months in Arizona.

Federal gun law and the badge

Police officers carry guns, and most department bans start with that fact. Federal law makes it a crime for anyone who is an unlawful user of or addicted to any controlled substance to possess a firearm, with a penalty of up to 15 years in prison. Recreational marijuana is still a Schedule I drug under federal law. The April 2026 order that moved state-licensed medical marijuana to Schedule III kept it a controlled substance and did not touch the recreational market.

There is an exemption, and it matters. The federal gun chapter does not apply to firearms issued for the use of a state, a city or another political subdivision, so a service weapon is outside the drug-user ban. A personal gun at home is not.

So can police officers smoke weed? In most departments the answer is no, on or off duty, and the federal gun ban is the reason departments such as Jersey City's have cited.

Hemani and the 2026 gun ruling

The Supreme Court ruled on the gun question this year. In United States v. Hemani, decided June 18, 2026, the justices took up the case of Ali Hemani, a Texas man charged under the federal gun law who had told law enforcement agents he used marijuana about every other day. The Court held that prosecuting him under the law’s unlawful user provision is inconsistent with the Second Amendment.

The judgment was unanimous, and Justice Neil Gorsuch, writing for the Court, called the case a narrow one. The ruling does not address efforts to ban addicts or people who are intoxicated at the time, and the opinion notes that the government moved some marijuana products to Schedule III after the Court heard oral argument. The decision makes it harder to prosecute an ordinary marijuana user for owning a gun. It does not tell a police department what its officers may do off duty.

New Jersey, the clearest yes

New Jersey went furthest. In April 2022, days before legal sales began, acting Attorney General Matt Platkin sent a memo to law enforcement leaders, and as the New Jersey Monitor reported, the memo makes clear police officers can consume marijuana legally purchased within the state while off duty. It set three rules:

  • Off-duty use of cannabis bought legally in New Jersey is allowed.
  • Use, possession or intoxication on duty gets zero tolerance.
  • Cannabis from the unlicensed market is banned at any time, on or off duty.

The memo also pointed out that the federal gun ban exempts firearms issued by a government agency. Jersey City resisted anyway. Its then-mayor, Steve Fulop, argued that federal law bars anyone who uses a controlled substance from having a gun, and after two officers tested positive in September 2022, the city fired them. Judges and the state Civil Service Commission ordered them reinstated, and on May 1, 2026, a state appeals panel ruled in their favor again. The officers still had not been returned to their old jobs, their lawyer said, while a third officer's firing was upheld because he bought from an unlicensed seller.

The memo covers only cannabis bought in the state, and New Jersey still bans home cultivation. An off-duty officer there can buy flower, such as Sour Strawberry, a Strawberry Kush and Sour Diesel cross at 27% THC, or London Pound Cake, a Sunset Sherbet and GSC cross at 30% THC, at a licensed dispensary, but growing either one at home would break state law.

The unexamined day is a wasted opportunity. Reflect on what you did, what you learned, and how you can improve.

John Dewey

Several legal states protect off-duty cannabis use for ordinary workers and leave police to their departments. New York's labor law protects legal cannabis use outside work hours, with exceptions for federal mandates, federal contracts or funding and visible impairment at work. In July 2022, the NYPD kept testing its members for marijuana despite orders from the city's law department, while the fire department stopped random and pre-employment tests.

Illinois legalized recreational cannabis in 2019, but Chicago still bans it for officers. In December 2025, the Chicago Police Board voted unanimously to fire a Chicago police officer who tested positive for marijuana, the first such firing since legalization. He had been tested during a fitness-for-duty exam.

The rules compare like this in six legal states:

StateRule for police and cannabis
New JerseyOff-duty use of legally bought cannabis allowed, zero tolerance on duty
New YorkOff-duty protection has no police exemption, but the NYPD kept testing in 2022
CaliforniaOff-duty protection law has no police exemption
WashingtonHiring protections exclude general-authority law enforcement agencies
MinnesotaBan on cannabis tests for job applicants does not cover peace officer jobs

California's case is the odd one. A 2024 state Senate analysis noted that its employment law does not expressly exempt law enforcement, and the 2025 code still names no police exemption, so how far departments there can go remains an open question.

Past marijuana use and police hiring

Rules on past marijuana use in police hiring have loosened as departments struggle to fill jobs. In Arizona, anyone who had used marijuana in the two years before applying would be turned away from the job, AZFamily reported in April 2025, but the state's police standards board cut that window to six months. The board also dropped older rules that disqualified anyone who had used marijuana more than 20 times in their life or more than four times after age 21. The Phoenix Police Department had more than 600 openings at the time.

So can you become a cop if you smoked weed in college? Usually yes, if enough time has passed. The waiting period depends on where you apply:

In Maryland, where recruits must be marijuana-free for three years, Montgomery County police were down 175 officers in early 2024, and county leaders asked the state's police standards commission to change the rule.

Officers themselves are split. In a 2016 Pew Research Center survey of 7,917 officers, 32% favored legal marijuana for personal and medical use, 37% favored medical use only and 30% wanted an outright ban. Among the public, the figures were 49%, 35% and 15%.

Advice before you apply

A police officer drug test for marijuana usually looks for THC metabolites, and THC can stay in your system for about 3 days after a single use and 30 days or more after heavy daily use. A hair test can look back about 90 days. In our experience, applicants who plan ahead have the fewest surprises:

  • Read the agency's own background standards, since lookback periods differ from one department to the next.
  • Count the months from your last use, not your last purchase.
  • Answer the background questions truthfully, since a background check is also a test of honesty.
  • Expect testing after you are hired too, whether at random, for cause or during a fitness-for-duty exam.

Can cops smoke weed? Federal gun law and department policy say no for most of them, and several legal states leave police out of their cannabis job protections. New Jersey stands out by allowing off-duty use of cannabis bought legally in the state, though Jersey City fought that rule for years, and the 2026 Hemani ruling narrowed federal gun prosecutions without changing department rules. For applicants, past use is less of a barrier than it was, as long as enough time has passed.
