What Happens to Legal Weed That Doesn't Sell?

Oregon's regulator estimated that demand accounted for 57 percent of the state's actual cannabis supply in a single year. The other 43 percent had to go somewhere.
Some of it sat in a warehouse losing potency. Some of it was ground up, mixed with kitchen scraps until it was more garbage than cannabis, weighed, logged and hauled to a landfill under video surveillance.
This guide covers how legal cannabis is actually destroyed, what can be salvaged and what cannot, how much surplus exists, and the slow chemistry that decides whether product is worth keeping at all.
The scale of the problem
Oregon publishes the clearest numbers, and they are stark. In its 2025 supply and demand report the state recorded a wet-weight harvest of over 5.7 million pounds and estimated that demand represented 57 percent of actual annual supply, down from 71 percent the year before, with median retail prices at $3.75 a gram, the lowest since legalization. The report warned of larger inventory stockpiles putting further downward pressure on prices.
Production kept climbing anyway. Oregon's 2025 harvest was the largest ever recorded while sales fell.
Michigan shows the same shape from the inventory side. State figures for December 2025 put 394,888 pounds of flower sitting at retailers and 883,985 pounds at processors, against a market moving roughly $269 million that month at an average of $58.22 an ounce. That is nearly 1.28 million pounds of flower in the pipeline in one state.
How it gets destroyed
You cannot simply throw cannabis in a dumpster. Every legal state requires it to be rendered unusable first, and the rules are specific enough to be interesting.
Washington requires grinding the waste and mixing it with other ground materials so that the resulting mixture is at least 50 percent noncannabis waste by volume. Acceptable mixers include food waste, yard waste and vegetable oils on the compostable side, paper, plastic and cardboard on the other. Licensees must keep records documenting the final destination and method for everything they destroy.
Colorado uses similar language and adds a word worth noticing. Waste must be made unusable and unrecognizable before it leaves the licensed premises, ground and mixed to at least 50 percent non-marijuana material and combined so that it cannot easily be separated and sorted. Everything must be weighed before it leaves, and the whole process runs through the state's inventory tracking system.
California requires that failed batches be rendered unusable prior to disposal, and that the rendering happen under video surveillance at any premises other than cultivation-only sites. The reason for disposal and the fate of the batch go into track and trace.
The picture that emerges is oddly industrial. Product that cost thousands to grow gets ground with garden waste, filmed, weighed, logged and driven to a landfill.
What can be saved
Not everything that fails testing is destroyed, but the exceptions are narrower than the industry would like.
Colorado's rules are the clearest published example. Remediation is allowed in only two scenarios, the state's guidance says, the first being flower that failed for microbial contamination, which may be processed into solvent-based concentrate.
That is the mechanism behind something consumers rarely think about. A batch of flower that fails a mold or yeast test does not necessarily vanish. In several states it can legally become distillate, because extraction and refinement remove the biological contamination along with everything else.
The hard limit is chemical. Pesticide failures and elemental impurity failures cannot be decontaminated at all, in Colorado or anywhere with comparable rules. If a retest fails, destruction is mandatory. You cannot extract your way out of a pesticide, because the pesticide concentrates alongside the cannabinoids.

Even product that never fails a test has a clock running on it.
THC degrades into CBN, and the rate is well documented. A 2025 study in Scientific Reports followed cannabis resin stored in dark, dry conditions at room temperature for up to eight years. Fresh samples measured 35.16 percent THC against 0.87 percent CBN. After two years THC had fallen to 2.74 percent while CBN had climbed to 6.94 percent, and after eight years THC sat at 0.44 percent.
That is resin and not flower, and the conditions were not optimized for preservation, but the direction is universal. Older work on stored cannabis found THC losing roughly 17 percent of its value in the first year and around 7 percent a year thereafter, with the CBN-to-THC ratio reliable enough to estimate a sample's age.
For a business, this means inventory is a depreciating asset in the most literal sense. Flower held for a year is measurably weaker flower, and in a market where product is priced on its THC number, that is a direct write-down.
For a consumer, it explains the taste and effect of cheap old flower, and why the sedating quality of aged cannabis is not imagination. CBN is what is left when THC breaks down.

What it costs to throw away
There is a tax wrinkle that makes destruction worse than it looks. Cannabis businesses cannot deduct ordinary operating expenses under Section 280E and are limited to cost of goods sold. That means the cultivation costs already properly capitalized into inventory can be recovered when product is written off, but the marketing, selling and administrative costs attached to it cannot be.
The Taxpayer Advocate Service has illustrated the general burden with a worked example showing a cannabis business paying roughly five times what a comparable non-cannabis business would owe. Destroyed inventory sits inside that arithmetic, which is one reason operators stretch to sell product cheaply instead of writing it off.
Why any of this happens
The surplus is not a mystery. It is a licensing decision. States that issued cultivation licenses without capacity limits got exactly what you would expect: more growers than the market could absorb, all of them expanding on the assumption that demand would keep climbing and federal legalization would open interstate sales. Neither happened. Interstate commerce remains illegal, so a pound grown in Oregon can only ever be sold in Oregon.
That is the structural trap. Every legal state is a sealed container. A grower in a state with ideal outdoor conditions cannot ship to a state with poor ones, so both states have to grow their own, and the good-climate state overproduces enormously.
The math that never applies at home
This is the part where the industry's problem and the home grower's problem are exact opposites, and it is worth spelling out.
Commercial overproduction is a coordination failure. Nobody wants a warehouse of aging flower, but every individual grower is right to plant as much as their license allows, because the alternative is losing shelf space to somebody who did.
A home grower has no such problem. You know exactly how much you use, and you can size a grow to it. Two plants of something that yields well will bury most people. That is why yield per plant matters more than most beginners realize, and why we keep breeding for it even though it is unfashionable next to flavor.

The other half of the lesson is storage, and the degradation data above is the argument. Airtight, dark, cool and stable. Not the freezer, which makes trichomes brittle, and not a windowsill. Grow what you will actually use in a year, and the CBN conversion never becomes your problem.
The short version
Legal cannabis that does not sell is ground up, mixed to at least half non-cannabis material, weighed, logged in state tracking systems and often filmed on the way out. Flower that fails microbial testing can frequently be extracted into concentrate. Pesticide and heavy metal failures cannot be salvaged at all.
