Can You Run a Daycare if You Use Cannabis?

Millions of Americans now use cannabis legally, and some of them look after other people's children for a living. The question they ask is a fair one: does a legal habit on your own time put a childcare license at risk?
Legal use, on its own, rarely disqualifies anyone. In most places the law treats a childcare provider and cannabis roughly the way it treats a childcare provider and alcohol: legal off duty, forbidden on duty. What goes further, in a growing number of states, is a ban on having cannabis on the premises at all.
Background checks look for convictions, not habits
The federal rules behind most childcare background checks care about criminal records, and legal use does not create one. The Child Care and Development Block Grant Act, which sets background check requirements for providers receiving federal childcare funds, lists the felonies that make someone ineligible to work in childcare. Among them is a drug-related offense committed during the preceding 5 years. Three details in that line matter:
- It covers felonies. A misdemeanor possession conviction is not on the federal list.
- The five years run from when the offense was committed.
- States may run a review process that clears someone disqualified only by that drug offense.
A childcare background check for cannabis therefore finds convictions, not use. Buying from a licensed dispensary in a legal state leaves nothing on a criminal record for a check to find. In a family child care home, federal rules extend the check to every resident aged 18 and over, not just the licensee, so the question applies to the whole household.
Drug testing is a separate issue. Several legal states protect off-duty cannabis use at work, but some carve out childcare explicitly. Minnesota lets employers test for cannabis in positions involving face-to-face care of children, and Connecticut exempts jobs requiring the supervision or care of children from its off-duty protection. In those states, a center can test staff and act on the results.
Washington draws the line at licensed space
Washington's early learning rules are the clearest example of how states separate home life from childcare. A center provider must prohibit anyone from using, consuming or being under the influence of cannabis on licensed space, full stop. A family home provider faces a narrower rule: a family home early learning provider must prohibit any person from using, consuming, or being under the influence of cannabis products in any form on licensed space during business hours.
The difference is intentional. A family home is also somebody's home, and the rule reaches only the approved childcare space and only during business hours. Storage is stricter. Any cannabis or paraphernalia has to be kept out of the licensed space entirely, somewhere inaccessible to children.
Oregon bans growing on the premises
Oregon's rules, rewritten in July 2025, go further than any other state's, and they are the ones a seed company's readers most need to know about. On registered family child care premises, a provider may not permit marijuana use during operating hours or when childcare children are present, all marijuana must be stored under a child safety lock or in a locked room, and no one shall grow or distribute marijuana on the registered family child care premises. The same wording applies to certified family homes.
That growing ban has no time limit. It applies around the clock, to the whole premises, and to everyone who lives there. Oregon's family child care marijuana rules also cover household members directly: anyone with access to the children must not be under the influence of a substance that impairs their ability to care for them, and residents count as having access even if they are rarely home during care hours.
In practice, that rules out exactly the kind of plant people keep at home. A compact autoflower such as Bubblegum Auto, which finishes 70 to 75 days from seed at 80 to 130 centimeters, or Lemon Cherry Cookies Auto at 80 to 110 centimeters, is built to fit a spare room or a closet, and in a licensed Oregon family child care home there is no spare room or closet where it is allowed. A provider who wants to grow has to do it somewhere else entirely, or not at all.

Maryland's family child care rule is broad in a different way. It reaches beyond the provider and beyond the premises. Under the regulation, a provider and any other individual may not consume or be under the influence of alcohol, cannabis, or an illegal or nonprescribed controlled dangerous substance while present at the home during operating hours, or while caring for children anywhere, including on outings and during transport. All cannabis, including edibles, must be kept out of children's reach.
Maryland also requires disclosure. If anyone living in the home smokes or vapes cannabis, the provider must tell parents in advance, before they place a child there. Minnesota has a similar disclosure rule for family day care homes that allow cannabis on the premises outside operating hours, down to a posted written notice.
Other states write the rule more generally. Colorado, Massachusetts and New York prohibit caregivers from being under the influence of any substance that impairs their ability to care for children, without naming cannabis specifically. The effect on duty is the same.

Why regulators are this strict
The rules are not a moral judgment about adult cannabis use. They respond to a measurable rise in children getting into it. Reporting on a study in the journal Pediatrics, NPR noted that there were just over 200 reported cases of accidental cannabis edible consumption by children under six in 2017, and that in 2021 the number shot up to 3,054, an increase of 1,375%. The study itself found that almost all of those exposures happened at home.
Edibles look like candy, cookies and gummies. A home daycare is a residence full of small children, which is exactly where the risk concentrates. Locked storage rules and bans on having cannabis in the licensed space are the regulatory answer to a real pattern of harm.
Four things to check before you apply
Every state handles a daycare license and marijuana use differently, and a provider's own licensing agency is the only authority on its rules. These are the questions worth answering first:
- Does your state bar cannabis on the premises entirely, or only in licensed space during operating hours? Washington and Oregon are very different.
- Who in your household is covered? Several states apply the rules, and the background check, to every adult resident.
- What storage does your state require? Locked rooms and child safety locks are becoming the standard.
- Does your state's employment law let a center test you? Childcare is a common exception to off-duty protections.
A written home daycare drug policy that answers those four questions, shared with parents at enrollment, is the simplest way to show a licensing inspector that the issue has been thought through.
Off duty, off premises, locked away
Legal cannabis use does not, by itself, stop someone from working in childcare. Federal background checks look for felony drug convictions within five years, not for legal adult use, and a purchase from a licensed store leaves nothing on a record.
What the rules forbid is consistent across every state: being impaired while caring for children. Beyond that, the states divide. Washington restricts licensed space during business hours, Maryland covers everyone present during operating hours and requires disclosure to parents, and Oregon bans growing anywhere on a licensed family child care premises around the clock.
